• ARTICLE 1 – PREAMBLE

• ARTICLE 2 – DEFINITIONS

Site: COMING HOME is a structure set up by AE MEDIA allowing Users to order access to events organized by AE MEDIA via the multi-platform videoconferencing service ZOOM.
Seller: Issuer of the offer proposed on the site and with whom an order for access to an event has been placed. This is the company AE MEDIA EIRL
User: Any visitor to the pages of the COMING HOME site.
Buyer: Any user accepting an offer made on the COMING HOME Site and ordering access to an event through the COMING HOME Site.


• ARTICLE 3 – PURPOSE

These General Conditions of Sale apply exclusively to the sale of access to an event on the Site for events organized by the Seller. These general conditions apply to the exclusion of all others. However, if different special conditions should apply for an event, they will be indicated on the presentation page of the event in question. Any order made on the Site necessarily implies the Buyer's full and unreserved acceptance of these general conditions of sale.


• ARTICLE 4 – PRICE

The prices are indicated in euros, all taxes included (French VAT and other applicable taxes), and are those in force on the day the order is taken. They include in particular the costs of processing the order. There are no shipping costs. The Seller reserves the right to modify its prices at any time. However, he undertakes to invoice access to an event ordered at the prices indicated when the order is registered. The Buyer is deemed to be in mainland France, the price is therefore invoiced to him, all taxes included.
 


• ARTICLE 5 – ORDER

5.1 The Buyer concludes the contract online on the Site at the electronic address: https://www.coming-home.live/

  In accordance with the provisions of article 1127-1 of the Civil Code, the Customer must follow a series of steps to conclude the contract electronically in order to be able to place his order: 

– Information on the essential characteristics of the Product; 

– Choice of the Product, if applicable, of its options;

– Indication of the essential contact details of the Customer (identification, email, etc.); 

– Acceptance of these General Conditions of Sale 

– Verification of the elements of the order and, if necessary, correction of errors. Before proceeding with his confirmation, the Buyer has the possibility of checking the details of his order, its price, and of correcting any errors, or of canceling his order. The confirmation of the order will result in the formation of this contract; 

– Follow-up of instructions for payment, payment of products, then delivery of the order. 

The Customer will receive confirmation by e-mail of the payment of the order, as well as an acknowledgment of receipt of the order confirming it after receipt of the full price.

Each step of the order is clearly explained on the Site. Access to the Site is guaranteed permanently, 24 hours a day, 7 days a week, subject to maintenance and upkeep periods, server update operations and any exceptional interruptions, subject to cases of force majeure and finally, subject to network saturation or interruptions relating to the network itself or the securing of user data. Except in cases of force majeure, interruptions will be reported on the Site at least 24 hours before the scheduled date.

5.2 – The contractual information is presented in French and is subject to confirmation at the latest when the Buyer's order is validated.

5.3 – Product offers are valid as long as they are visible on the Site.

5.4 – Any order signed by the Buyer with a “click” confirming the order constitutes irrevocable acceptance which can only be called into question within the limits provided for by these general conditions of sale. The "click" of order confirmation constitutes an electronic signature. This electronic signature has value between the parties in the same way as a handwritten signature. Once the order has been validated by this "click" of order confirmation, the buyer will receive an electronic confirmation, which will summarize the essential elements of his order.

5.5 – The Seller reserves the right to refuse an order placed by a Buyer who has not fully or partially paid a previous order or with whom a payment dispute is in progress.
 


5.6 – The Seller reserves the right to refuse the order of a large quantity of access for the same event (same place, same date, same event), and this from 2 accesses


• ARTICLE 6 – TERMS OF PAYMENT AND INVOICING

6.1 Payment is made in euros.

6.2 The payment of orders is made by credit card usable on French territory. The debit of the Buyer's bank account may be deferred for a few days.

6.3 The payment system is entrusted to STRIPE or PAYPAL, service providers specializing in the management of online payments. The Buyer's banking information is protected thanks to its security via the SSL protocol which systematically checks the validity of access rights during payments by credit card and encrypts all exchanges in order to guarantee confidentiality. The transaction will be concluded subject to the final validation of the order by the Buyer and the acceptance of the transaction by STRIPE or PAYPAL and by the Seller. The Seller may contact the Buyer by email or telephone to obtain additional information on his identity (identity card) and on the identity of the holder of the bank card used for payment. The total amount of the transactions will be exactly equal to the amount indicated in his "basket" when accepting the order.


• ARTICLE 7 – OBTAINING ACCESS

Unless expressly stated otherwise, confirmation by electronic means with the access link to the event is sufficient to be able to access the event, so there is no shipping.


• ARTICLE 8 – FORCE MAJEURE – ACT OF THIRD PARTIES

8.1 The Seller's liability cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.

8.2 The Seller's liability cannot be engaged if the non-execution or the delay in the execution of one of its obligations results from the fact of a third party, in particular in the event of disruptions or delays in postal services, means transport and/or communication.
 


• ARTICLE 9 – RIGHT OF WITHDRAWAL – LOSS – CANCELLATION

9.1 In accordance with the legal provisions, no right of withdrawal can be exercised for access to an event. Access to an event cannot be taken back, exchanged or refunded, except possibly in the event of cancellation or decision by the seller to refund access.

9.2 In the event of cancellation, postponement, interruption, modification of program or distribution, reimbursement will be subject to the sole conditions of the Seller, who is solely responsible. The Buyer authorizes the Seller, upon announcement of the cancellation or modification of the date, time or place of an event for which he has reserved access, to use the contact details he has entered when ordering to keep him informed of the procedure to follow. No obligation of information or assistance can however be deduced from the previous paragraph for the Vendor to the Buyer.
 


• ARTICLE 10 – APPLICABLE LAW

These general conditions of sale and the contract concluded between the Seller and the Buyer are entirely governed by the provisions of French law. In the event of difficulties arising in the interpretation, execution or termination of the contract concluded between the Seller and the Buyer, the Commercial Court of LYON shall have sole jurisdiction.


• ARTICLE 11 – PROTECTION OF PERSONAL DATA
 

In accordance with Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, the Seller sets up a processing of personal data which has the purpose of purpose the sale of services defined in this contract. 

The Buyer is informed of the following: 

- Identity and contact details of the controller: the Seller, as indicated in article 2 of these GCS 

- Contact details of the data protection officer: Mr. Alain ESKENAZI, legal representative of AE MEDIA

- Legal basis for processing: contractual performance 

- Recipients of personal data are: 

- the data controller

- the subcontractor involved in the management of payments 

- any authority legally authorized to access the personal data in question 

- No transfer outside the EU is planned 

- Duration of data retention: the time of the commercial prescription 

- The Buyer has the right to ask the controller for access to personal data, the rectification or erasure of the latter, or a limitation of the processing relating to the person concerned, or the right to object to processing and the right to data portability 

- The Buyer has the right to lodge a complaint with a supervisory authority 

- The information requested when ordering is necessary for the delivery of the goods ordered, otherwise the order cannot be placed. No automated decision making or profiling is implemented through the ordering process.

The Site may also use 'cookies'. The cookie makes it possible to personalize the offers by signaling the passage of the buyers on the site. A cookie will be installed in the Buyer's computer. This cookie does not make it possible to identify the Buyer, on the other hand, it records information relating to the navigation of his computer on the Site (pages consulted, date and time of consultation, etc.) which may be used during subsequent visits. The Purchaser may oppose the registration of cookies by configuring his browser from the "Tools" menu.


• ARTICLE 12 – INTELLECTUAL PROPERTIES

All texts, images, logos, sounds and other works reproduced or represented on the Site are protected by intellectual property. No use, subject to the exceptions provided for by the intellectual property code, is authorized. Any reproduction or representation, total or partial, of the Site or of the elements posted on the Site is prohibited.


• ARTICLE 13 – LIABILITY

Compliance with French legislation concerning the Site and the products sold online is the responsibility of the Seller. On the other hand, the Seller cannot be held liable in the event of the violation of the legislation of another State. The Purchaser must take care to respect the national or international rules to which he is subject (for example in the event of a ban on a title, etc.). The responsibility of the Seller cannot be engaged if it turns out that the delivery of an order is impossible with regard to the legislation of the State in which the delivery must take place. Product illustrations have no contractual value.


• ARTICLE 14 – CONTACT DETAILS OF THE COMPANY RESPONSIBLE FOR THE SITE
